Sometimes, these injuries have short-term consequences, such as a scratch or a bruise. Sadly, though, in some cases, the effects are permanent and can have long-term impacts on your child's development -- and your finances.</p>

<p>Some common childbirth injuries include fractured bones, facial paralysis, Erb's palsy and cerebral palsy.</p>

<p>In some of these instances, the outcome was inevitable. But in many others, the injuries were the direct result of some form of medical malpractice.</p>

<p>Childbirth can be a painful process for mother and child, and proper medical care is essential to ensuring the health and safety of both.</p>

<p>Fractured bones will typically heal on their own, but facial paralysis, which can result from pressure being placed on the baby's head or face with forceps, often requires surgery to fix nerve damage.</p>

<p>Erb's palsy is more severe. Also known as brachial palsy, it happens when the nerve that controls the baby's arm movement is damaged, usually when the child's head or neck is pulled to the side when the shoulders pass through the birth canal, or when the baby is pulled out by the shoulders. Mothers are known to be at risk even before delivery if the child is in the breech position or if the mother is diabetic and has a larger than average baby. Because of improvement in delivery techniques, this type of injury is less common than it used to be, but if it does occur, it can require surgery to fix.</p>

<p>One childbirth injury that has long-lasting effects is cerebral palsy, which occurs when the baby is deprived of oxygen during delivery. The outcome is often serious and permanent brain damage. In many cases, it is preventable and could be due to negligence by medical professionals.&nbsp;</p>]]>

<p>While Mayor Michael Bloomberg, alongside traffic and police officials, announced that 2011 boasted the lowest number of traffic fatalities since 1910, there were still 247 people who were killed in city car crashes last year.</p>

<p>Our <a href="http://www.quellerfisher.com/Attorneys/" target="_blank">New York car accident attorneys</a> believe that's far too many.</p>

<p>Last year, the city's transportation department implemented a number of traffic safety measures along 60 miles of city streets, including redesigns, creation of the city's first slow zone in the Bronx and electronic speed boards in each of the five boroughs to broadcast the speed of passing vehicles, and make drivers more aware of their rate of travel.</p>

<p>But there is still so much more that needs to be done to promote the safety of New Yorkers.</p>

<p>Last year, the New York City Police Department issued more than 1 million summonses for traffic violations and there were 8,500 drunk driving arrests throughout that same time. Those are only the individuals who were caught - the actual number of drunken drivers is likely much higher.</p>

<p>There were also more than 130 pedestrian fatalities last year - with nearly half of those involving elderly people and almost 30 percent involving children. These are our most vulnerable populations, and we need to be doing everything possible to protect them from these dangers.</p>

<p><a href="http://www.nyc.gov/html/dot/html/safety/safetips.shtml" target="_blank">The New York Department of Transportation</a> Offers the following tips on how to reduce New York City car accidents and injuries:</p>

<p>1. Keep a look out for pedestrians before backing up. Pay particular attention for children who may dart out suddenly, and be sure to give pedestrians extra space by stopping before you get to the crosswalk, rather than stopping in it.</p>

<p>2. Travel the speed limit.</p>

<p>3. Make sure to use your headlights starting at dusk and until dawn and also in bad weather.</p>

<p>4. Use your seat belts and car seats - properly.</p>

<p>5. Don't drive if you've been drinking or using drugs. If you are thinking about getting behind the wheel impaired, think about this: your license will be immediately suspended if you have a blood alcohol level that is above 0.08. If you refuse the breath test, you will also automatically have your license revoked and you'll be subject to heavy fines.</p>

<p>6. Don't use a cell phone if you're driving. In New York state, hand held cell phones are forbidden for drivers on all public roads, except in rare cases of emergency.</p>]]>

<p>The University of Maryland Hospital for Children <a href="http://www.timesunion.com/news/article/Study-You-are-more-likely-to-die-walking-with-2578662.php" target="_blank">University of Maryland Study</a> that the death rate has tripled for headphone-wearing pedestrians in the U.S.</p>

<p>But advocates at Transportation for America are firing back on those claims, saying that the study sample was so minimal, it's not an accurate reflection of the true causes of pedestrian deaths. Further, the advocates say the study only serves to blame the victim - something that isn't helpful when proposing solutions.</p>

<p>According to the study, there were 16 headphone-wearing pedestrians killed between 2004 and 2005. Contrast that with the 47 killed in 2010-2011.</p>

<p>Sure enough, it's grown substantially.</p>

<p>But now examine the total number of pedestrian fatalities, which were nearly 48,000 between 2000 and 2009. That means that the study sample represents about 0.3 percent of all pedestrian deaths.</p>

<p>Our <a href="http://www.quellerfisher.com/Contact.shtml">Manhattan pedestrian accident attorneys</a> realize that distraction can kill, whether you are behind the wheel or navigating New York's busy streets. But the truth is, the majority of pedestrian accidents happen because the driver of the motor vehicle wasn't paying attention. The New York Department of Transportation reported that 36 percent of pedestrian accidents were the fault of the driver, while 27 percent involved the pedestrian's failure to yield.</p>

<p>Pedestrian crashes were deadlier on the city's busier roads, and a speeding vehicle only increased the risk of fatality.</p>

<p>The department also reported that pedestrians were four times as likely to be struck and killed or seriously injured while in Manhattan than in any of the other four boroughs.</p>

<p>That's why the agency is implementing a safety plan that includes installing 1,500 new countdown lights for pedestrians at various intersections, using crash data to strategically select 60 miles of streets to re-engineer for optimal pedestrian safety and launching a pilot program to test a 20 mile-per-hour speed limit in residential neighborhoods.</p>]]>

<p>Mayor Michael Bloomberg and the city's building commissioner held a <a href="http://ohsonline.com/articles/2012/01/26/nyc-constructionrelated-accidents-fell-18-percent-last-year.aspx?admgarea=news" target="_blank">press conference</a> recently to announce an 18 percent reduction in New York construction accidents last year. Injuries in the construction industry are also on the decline, with 152 reported last year, versus 165 the year before - equaling a nearly 8 percent reduction.</p>

<p>As Manhattan construciton accident attorneys, we always take such reports with a grain of salt. Fact is, construction is the most dangerous occupation. The high rate of serious and fatal injury has been a fact of life for decades. Numbers fluctuate and can even be manipulated by those seeking grant dollars or for political reasons. And the number of serious or fatal accidents are bound to increase with the recovering economy.</p>

<p>City officials credit the introduction of 25 new laws pertaining to construction safety (did we say political reasons?), which include bans on smoking, mandatory training for all workers on tower cranes and the requirement of color-coded uniforms and pressure tests for standpipe sprinklers.</p>

<p>Our <a href="http://www.quellerfisher.com/Contact.shtml">New York construction accident attorneys</a> urge construction workers and those in the industry to continue implementing the industry standard safety practices.</p>

<p>Unfortunately, when construction accidents do happen, they're often serious.</p>

<p>Most construction injuries in New York are the result of falls, many of which are 100 percent preventable.</p>

<p>According to the U.S. Census, preliminary 2010 totals indicate more than 4,500 workers were killed on construction sites across the U.S - about the same as the statistics from the year before.</p>

<p>At its record high, there were 847 fatal falls in the private construction industry in 2007.</p>

<p>The U.S. Occupational Safety and Health Administration further reports that on any given day, there are more than 250,000 construction sites where about 6.5 million people are employed.</p>

<p>In New York, the city report the number of construction permits climbed nearly 8&nbsp; percent in the last year, totaling nearly 87,000 permits in 2011.</p>

<p>Construction workers remain at greater risk than other professionals.</p>

<p>That's why last year, city officials launched a campaign known as "Experience is not Enough," which underscored the importance for construction workers to use proper fall protection gear, such as harnesses, nets and guardrails.</p>

<p>As mentioned earlier, falls are the top cause of injury on a construction site. OSHA reports other causes of injury or fatalities include:</p>

<p>-Trench collapse.</p>

<p>-Scaffold collapse.</p>

<p>-Electric shock.</p>

<p>-Failure to use proper equipment.</p>

<p>That choice can be further complicated when you live hundreds or thousands of miles away, as is the case for an increasing number of Americans, according to a recent report by The Associated Press.&nbsp;</p>

<p>The National Institute on Aging estimates there are about 7 million people in the country who are overseeing the care of a beloved senior citizen.</p>

<p>This is due to a myriad of reasons, including a languishing economy that has people snapping up any job available - even if it means moving across the country and away from aging parents or loved ones.</p>

<p>Compounding that is the fact that as the Baby Boomer generation continues to age, the number of younger residents is expected to remain about the same or possibly decline. What this means is that fewer people will be responsible for the care of a quickly swelling number of older citizens - and they may have to do it from farther away.</p>

<p><a href="http://www.washingtonpost.com/national/health-science/as-america-ages-millions-try-to-juggle-ailing-parents-caregiving-needs-from-afar/2012/01/26/gIQASRsATQ_story_1.html" target="_blank">The Associated Press</a> chronicled the real-life faces of these struggles, one of those being Kay Branch of Alaska. Her parents live nearly 4,000 miles away, in Florida.</p>

<p>"You just want to be in two places at once," she told the newspaper.</p>

<p>It's frustrating, she said, when a situation arises - a medical emergency, a problem with insurance, etc. - not to be right there. In many cases, getting there means an expensive flight that will take at least one day, if not longer.</p>

<p>The threat of nursing home neglect and abuse is a real problem that shouldn't be overlooked, especially because so often, our elderly relatives can't speak for themselves, either out of fear or due to cognitive health issues, such as dementia or Alzheimer's disease.</p>

<p>The <a href="http://www.health.ny.gov/facilities/nursing/select_nh/select_nh.htm" target="_blank">New York State Department of Health</a> is one entity that recognizes this, and provides a guide for residents to use when searching for a long term care facility.</p>

<p>The first recommendation is to begin thinking about and researching several nursing homes long before you may think it's necessary. That way, when it's time to make a decision, you're prepared and the process is less stressful.</p>

<p>Important considerations are what type of special needs your elderly loved one may have, and whether the nursing home you are examining can meet those specific needs.</p>

<p>Also be sure to ask about the most recent inspection at the facility, whether there were any violations and if so, an explanation of those violations and how they were addressed.</p>

<p>Payment methods should also be a consideration - whether Medicare will pick up the tab, or whether you may be responsible for some of the costs.</p>

<p>No matter which facility you choose, please remember that in the state of New York, nursing home residents have the following rights:</p>

<p>-The right to dignity, respect and a comfortable living environment.</p>

<p>-The right to quality of care, without discrimination.</p>

<p>-The freedom to make independent choices.</p>

<p>-Protection for property and money.</p>

<p>-Privacy in their communications.</p>

<p>-The right to participate in activities they want, and to refrain from those they don't.</p>

<p>-An easy, forthright complaint procedure.</p>

<p>Begin 2012 with a resolution to be a safe driver and adopt responsible habits behind the wheel.</p>

<p>The <a href="http://www.aaafoundation.org/pdf/2011TSCPR.pdf" target="_blank">AAA Foundation</a> reports that there is a "do as I say, not as I do," attitude among many drivers. Nationwide, an overwhelming number of survey respondents said not wearing a seatbelt is not acceptable. Yet, nearly a quarter reported doing just that within the last month. Additionally, most drivers said it's not Ok for drivers to travel 10 mph above the speed limit on residential streets, but many admitted to it themselves within the previous 30 days.</p>

<p>Perhaps most startling, 76 percent of motorists said drinking and driving is absolutely unacceptable. And yet, more than 14 percent said they had been impaired behind the wheel. Of those, 21 percent said they had done so within the last month.</p>

<p>We understand that car accidents in New York City and across the country aren't always preventable. But there are measures you can take to make your drive safer.</p>

<p>--Don't drink and drive.</p>

<p>--Put away your cell phone. While 94 percent of drivers said texting and driving is dangerous, more than a third admitted to reading a text or e-mail while driving within the previous 30 days.</p>

<p>--Slow down and heed red lights. About 94 percent of drivers said running a red light is extremely unsafe, but 37 percent have done it themselves in the last month.</p>

<p>--Don't drive if you are too sleepy or have trouble keeping your eyes open.</p>

<p>According to <a href="http://www.foxnews.com/health/2012/01/12/fda-jj-delayed-reporting-insulin-pump-problems/" target="_blank">FoxNews</a>, the revelation of faulty diabetic insulin pumps follows a stunning string of 30 product recalls in just the last two years. Those recalls have included everything from headache medicine that reportedly didn't have the proper dosage of active drugs to contact lenses that burned the eyes.</p>

<p>Our <a href="http://www.quellerfisher.com/Medical-Malpractice/">New York City medical malpractice attorneys</a> believe you should be able to expect safety when using FDA-approved health care products. But as these incidents illustrate, consumers must constantly pay attention not only to product recalls, but to the hazards of approved devices in the marketplace.</p>

<p>In this case, what has regulators furious is not simply the fact that the insulin pumps were faulty - even resulting in the hospitalization of three people who experienced perilously high blood sugar and respiratory failure. It is the fact that Johnson &amp; Johnson delayed reporting two of those incidents and failed to report the other altogether.</p>

<p>The pumps provide life-saving shots of insulin to diabetic patients. In this case, the FDA reports, the pumps were not administering the proper dosage and the key pads on the pumps were also faulty. But, they said, the company continued to sell them anyway.</p>

<p>Erik Gordon, professor of Michigan's Ross School of Business, told FoxNews that to have one or two of these incidents might be a coincidence. Given the sheer volume of problems Johnson &amp; Johnson has had, however, points to a more serious problem.</p>

<p>Last year, recalls cost the company an estimated $900 million in lost revenues.</p>

<p>The FDA has ordered an explanation from the company, and is continuing to investigate. The company also manufacturered the DuPuy hip, which is under recall.</p>]]>

<p><a href="http://www.nyc.gov/html/dot/html/about/pedsafetyreport.shtml" target="_blank">The Department of Transportation</a> reports that traffic crashes cost the city's economy an estimated $4.29 billion every year.</p>

<p>The main causes for pedestrian deaths were driver inattention and the pedestrian's failure to yield. The most serious New York City crashes involving pedestrians happened on major roadways, as opposed to quieter streets.</p>

<p>In fact, pedestrians accounted for 52 percent - more than half - of all traffic fatalities in the city. In most cases where pedestrians were killed or seriously hurt, the driver was male and the vehicle was private, as opposed to a taxi or city bus.</p>

<p>Manhattan, in particular, is known to be the most dangerous of all the five boroughs, with four times as many pedestrians killed there than anywhere else.</p>

<p>Police Commissioner Raymond Kelly said his department was committed to continuing to reduce all traffic deaths in New York City by enforcing laws regarding some of the riskiest behind-the-wheel behavior - namely, drunk driving, distracted driving, and failure to wear a seatbelt.</p>

<p>Based on a recent analysis of pedestrian fatalities, the transportation department has committed to improving pedestrian safety in the following ways:</p>

<p>--Outfitting an estimated 1,500 intersections with pedestrian countdown signals.</p>

<p>--Testing to see whether a 20 mph speed limit would increase pedestrian safety in local neighborhoods.</p>

<p>Late last year, 53-year-old tow truck driver Todd Young was killed in Syracuse while he was working to load a disabled vehicle. The Post-Standard reported he was working the night shift when he was struck by a tractor trailer.</p>

<p>Young was declared dead at the scene, while the driver of the truck was ticketed for unsafely switching lanes.</p>

<p>Tom Brennan, head of the Empire State Towing and Recovery Association, was quoted as saying he fully supports the laws' expansion, having been involved in two roadside traffic accidents in New York himself - one of which caused serious injury to his customer.</p>

<p>The new law requires New York motorists to change lanes when there is an incident involving not just red flashing lights, but now amber flashing lights as well. If a driver can't safely change lanes, they are required to slow down.</p>

<p>Violators of this law could be fined more than $300 and be sentenced to a possible 15 days in jail.</p>]]>

<p>The government estimates more than 130,000 Medicare patients are victimized by medical error each month.</p>

<p>In previous discussions about the epidemic of medical errors, experts reported issues with hospital employees fearing to admit mistakes. This report indicates many hospital employees do not have the knowledge or training to even understand that a mistake has occurred.</p>

<p>A French company that produces implants has been accused by authorities of using defective and dangerous materials in production.&nbsp; The company stopped making the implants after a woman died after surgery in 2010.&nbsp; ALCL has been diagnosed in women who had both silicone and saline breast implants.</p>
